A class action has been filed against Baybridge Szechuan Restaurant and its owner claiming they violated the Fair Labor Standards Act (FLSA) when paying their workers. Filed in New York by a former waiter, the lawsuit alleges the defendant failed to pay its employees for all hours worked—including spread-of-hours premiums—as well as FLSA-mandated minimum and overtime wages. The plaintiff alleges he, alongside teams of similarly situated servers, often worked more than 50 hours a week at a flat rate of pay without receiving the time-and-a-half rate required under the FLSA. On days where he worked longer than a 10-hour shift, the lawsuit continues, the plaintiff was not given his spread-of-hours pay as called for by state law.
