Hernandez v. Spring Rest Group, LLC et al.
Filed: August 11, 2017 ◆§ 1:17-cv-06084
Spring Rest Group, LLC, which operates Gatsby's Bar in New York City, is facing a lawsuit claiming the company failed to pay proper wages.
Spring Rest Group, LLC, which does business as New York City eatery Gatsby’s Bar, and its two owners are the defendants in a proposed collective action filed by a former employee who claims he worked long days as a cook without being paid proper wages. Citing possible Fair Labor Standards Act (FLSA) and New York Labor Law violations, the complaint alleges the plaintiff, who worked for the defendants from June 2008 until July 2016, at varying times, worked anywhere between 58.5 to 81 hours per week without receiving appropriate minimum, time-and-a-half overtime, or spread-of-hours pay. In fact, the man’s pay never varied no matter how many hours he worked beyond his typical schedule, the lawsuit continues. Even further, the plaintiff claims he was never granted meal or rest breaks during his workdays, nor provided accurate (and mandatory) wage documents.
