A lawsuit out of Arkansas federal court accuses The Lilly Company of misclassifying a former employee as exempt from overtime wages.
The complaint says the plaintiff worked as a “parts department manager” out of the company’s Jonesboro warehouse, where he was responsible for filling out customer and mechanic orders. The man alleges he put in over 50 hours of work per week and was paid the same weekly salary regardless of the number of hours he worked.
The suit claims that the plaintiff, despite being paid a salary, was actually a non-exempt employee entitled to overtime wages because he had the same duties as hourly paid employees and didn’t have any control over the business or its staff.
