Metro Diner Management, LLC, Metro Services LLC and four other parties have been named in a wage and hour lawsuit filed in Pennsylvania on behalf of Metro Diner servers.
Metro Diner Management, LLC, Metro Services LLC and four other parties have been named in a wage and hour lawsuit filed in Pennsylvania on behalf of Metro Diner servers nationwide who worked “during the maximum statutory limitations period.” The lawsuit claims the defendants paid its servers the tipped minimum wage even when they performed non-tipped tasks such as cleaning, re-stocking and clearing tables. Allegedly, servers also had the cost of their uniforms taken out of their paychecks, causing their wages to fall below the minimum wage, and were required to take part in an invalid tip pool. In addition to breaking federal law, the lawsuit claims, the defendants also violated two Pennsylvania state regulations.
