MedQ Settlement Offers Cash, Credit Monitoring to Resolve Class Action Over 2023 Data Breach

MedQ has agreed to a class action settlement that includes cash payouts and credit monitoring for those impacted by a December 2023 data breach.
A class action settlement with MedQ offers cash payments and credit monitoring services to more than 54,200 people who were notified that their personal and/or medical information may have been exposed in a December 2023 data breach.

The MedQ class action settlement received preliminary court approval on September 9, 2025 and covers all United States residents who received a Notice of Data Breach letter from MedQ.
The court-approved website for the MedQ settlement can be found at MedQIncDataSettlement.com.
According to the settlement website, MedQ settlement class members who submit a timely, valid claim form will be able to receive credit monitoring services and either a one-time, $50 cash payment or up to $5,000 in reimbursement for documented, out-of-pocket expenses related to the data breach. The class action settlement also allows eligible consumers to submit a claim form for reimbursement for up to three hours of time spent responding to the data breach, at a rate of $30 per hour, the website adds.
Per settlement documents, the credit monitoring includes two years of three-bureau credit monitoring services, which include real-time monitoring of credit files, comprehensive public records and medical identity monitoring, and dark web scanning and identity theft insurance.
Out-of-pocket losses covered by the MedQ settlement can include, but are not limited to:
- Fees or costs of ID replacement, credit reports, credit monitoring and freezing/unfreezing credit;
 - Postage to contact banks by mail; and
 - Losses caused by identity theft or fraud.
 
Class members in search of reimbursement for out-of-pocket expenses must submit proof of each loss, such as receipts or bank statements. Similarly, MedQ class members looking to receive reimbursement for lost time must submit an attestation that they spent that time on tasks related to the data breach and its fallout.
Importantly, the $50 cash payment is mutually exclusive from the other reimbursement options and cannot be claimed alongside either the time or expense reimbursement, the website specifies.
To submit a claim form online, class members can visit this page of the MedQ settlement website and log in with the unique ID and PIN found in their copy of the settlement notice.
Alternatively, a PDF claim form is available to print, fill out and mail back to the address listed on the third page of the form.
All MedQ claim forms must be submitted online or postmarked by December 15, 2025.
MedQ has also agreed, as part of the settlement, to implement security enhancements to its data systems in the wake of the data breach.
A hearing is scheduled for December 18, 2025 to determine whether the settlement will receive final approval from the court. Settlement benefits will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The MedQ class action lawsuit claimed that the medical tech company failed to protect the personal data in its care from a late-December 2025 data breach, which supposedly compromised the information of approximately 54,229 people.
