Leidos Health, LLC is facing a proposed class and collective action filed by a former employee who claims he was misclassified as an independent contractor and denied his rightful overtime wages. The plaintiff says he worked as a consultant for the information technology company between January 2013 and June 2016, training its clients to use a new hospital electronic recordkeeping system. Though the plaintiff regularly worked more than 40 hours per week – as many as 12 hours per day, seven days a week, according to the complaint - he was not paid time-and-a-half overtime for the hours worked beyond 40, as mandated by the Fair Labor Standards Act. He claims the defendant improperly classified him as an independent contractor even though his job responsibilities were more characteristic of an employee who should have been eligible for overtime wages.
