Islander Stucco Systems, Inc. and an individual with control of the business are defendants in a proposed collective action filed by two former employees who claim they were not paid proper overtime wages in accordance with the Fair Labor Standards Act.
Islander Stucco Systems, Inc. and an individual with control of the business are defendants in a proposed collective action filed by two former employees who claim they were not paid proper overtime wages in accordance with the Fair Labor Standards Act. The plaintiffs say they worked for the defendants as stucco, plaster, and exterior insulation and finish system (EIFS) applicators. They allegedly worked more than 40 hours per week but, according to the complaint, never received time-and-a-half overtime wages for the hours they worked beyond 40. Additionally, the suit claims employees like the plaintiffs sometimes received “an improper cash payment separate from their paycheck.”
