The HEXPOL class action settlement received preliminary court approval on February 12, 2026 and covers all United States residents whose personally identifiable information was compromised in the data breach discovered by the manufacturer in December 2024, including all those who received notice of the breach.
Court documents state that an estimated 1,921 current and former HEXPOL employees may have been affected by the data breach.
The court-approved website for the HEXPOL data breach settlement can be found at HEXPOLDataSettlement.com.
According to the agreement, HEXPOL settlement class members who submit a timely, valid claim form are eligible for multiple settlement benefits.
The deal states that class members who submit a claim form with documented proof of out-of-pocket losses incurred because of the breach are eligible to receive up to $5,000 in reimbursement. Per court documents, class members must include third-party documentation, like receipts or bank statements, to show how much they lost or spent. Covered losses or expenses may include losses related to identity theft and fraud, fees for credit reports or credit monitoring, costs to replace IDs, postage to contact banks by mail, or accountant fees or other expenses related to tax issues.
All class members may additionally submit a claim form to receive reimbursement for up to ten hours of lost time spent dealing with tax-related issues, at a rate of $25 per hour, for a maximum payout of $250. To receive this benefit, class members must include third-party documentation supporting their claim and a brief description of their activities.
In addition to monetary compensation, class members may file a claim form to receive three free years of CyEx Financial Shield Pro, a credit monitoring product that includes identity theft insurance.
Class members who do not submit a claim for documented losses, lost time or credit monitoring may instead submit a claim form to receive an alternative cash payment of $70, with no proof required, the agreement states.
Class members may choose to receive their payments electronically or via check, and all checks must be cashed within 90 days of issuance before expiration, the agreement states.
To submit a HEXPOL settlement claim form online, class members can head to this page and enter the unique ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete, and return by mail to the settlement administrator.
All HEXPOL claim forms must be submitted online or postmarked no later than June 15, 2026.
Finally, HEXPOL has agreed to implement improvements to its information security to mitigate the risk of a future data breach.
The court will determine whether to grant the HEXPOL settlement final approval following a hearing on August 11, 2026. Compensation will begin to be distributed to consumers only after final approval has been granted and any appeals have been resolved.
The HEXPOL class action lawsuit alleged that the company, which manufactures polymer compounds, failed to implement reasonable cybersecurity measures to protect information stored on its systems, leading to a data breach on December 22, 2024 that compromised current and former employees’ private information. Per the filing, the confidential information extracted during the breach included full names and Social Security numbers.
