Eligible for the HealthPort class action settlement are patients, patient designees, and patient representatives who requested medical records from a Pennsylvania healthcare provider or facility in connection with patients’ applications for life and/or health insurance, referred to by HealthPort as “underwriting” requests, and who paid to HealthPort an amount in excess of the maximum basic, search and retrieval, and/or reproduction fees as set forth in 42 Pa.C.S. § 6152(a)(2)(i) of the Pennsylvania Medical Records Act and who were not charged in accordance with an agreed-upon rate, during the period of December 17, 2009 through July 23, 2026.
Court documents state that there are approximately 2,056 settlement class members.
The court-authorized HealthPort Datavant class action settlement website can be found at HealthPortPITSettlementPA.com.
Class members who file a timely, valid claim form can receive a cash payment equal to 67.5 percent of the alleged overpayment of the invoiced amounts for basic fees, search and retrieval fees, and/or per-page copying fees for each record request made.
Should the total value of all valid claims exceed the $197,720.39 cap on monetary benefits, payments to class members will be reduced on a pro rata (proportional) basis.
To file a HealthPort settlement claim form online, class members can head to this page and enter the notice ID and PIN found on their copy of the settlement notice.
All HealthPort Datavant settlement claim forms must be submitted online by December 31, 2026.
The court will determine whether to grant final approval to the HealthPort class action settlement following a hearing on December 1, 2026. Compensation will begin to be made available to class members only after final approval has been granted and any appeals have been resolved.
The HealthPort Technologies class action lawsuit alleged that the healthcare information management company charged individuals or businesses for records requested in connection with a patient’s application for health and/or life insurance in excess of the state “ceiling” established by the Pennsylvania Medical Records Act.
