The deal, which received preliminary approval from the court in late May 2025, covers all individuals who received notice from the medical facility about the Gramercy Surgery Center data breach in June of last year.
Gramercy notified approximately 52,372 people about the incident, according to the settlement agreement.
To receive Gramercy Surgery Center settlement benefits—including credit monitoring services, reimbursement for certain expenses or a cash payment—eligible class members must submit a valid claim form online or by mail by September 29, 2025.

To submit a claim form for the Gramercy Surgery Center class action settlement, you will need your unique Notice ID, which can be found in the personalized settlement notice you should have received in the mail. Online submission also requires a confirmation code that is provided on the notice.
As part of the deal, class members who file a timely, valid claim form are eligible to receive reimbursement of up to $2,500 per person for documented out-of-pocket expenses that were incurred between June 14, 2024 and September 29, 2025 and were “more likely than not” caused by the data breach, the official Gramercy settlement website says. According to the site, qualifying expenses may include fees related to fraud or identity theft, phone or data charges, credit repair service costs, expenses for postage or gas, bank fees or other unreimbursed losses.
Class members are also eligible to receive compensation for up to three hours of lost time spent handling the incident, at a rate of $20 per hour, the website relays.
In lieu of these reimbursements, consumers can file a claim to receive a $50 cash payment, the site states.
Per the settlement agreement, Gramercy will pay up to $400,000 for the aforementioned cash benefits, and individual payout amounts will be adjusted on a pro rata basis depending on the total number of valid claims that are submitted.
In addition, consumers can enroll in three years of complimentary one-bureau credit monitoring services, which are available to all class members regardless of whether they submit a claim for expense reimbursement or a cash payment, the website shares.
Finally, as part of the deal, Gramercy has modified certain business practices to better safeguard the sensitive information stored on its systems, the site adds.
The court will decide whether to grant final approval to the terms of the Gramercy class action settlement at a hearing on October 21, 2025.
According to the website, Gramercy settlement benefits, including credit monitoring enrollment information, will begin to be issued to eligible class members only if the deal receives ultimate court approval and after any appeals are resolved.
The lawsuit against Gramercy Surgery Center alleges that the data breach, which occurred between June 14 and June 17, 2024, was the result of inadequate cybersecurity on the part of the facility.
The data breach lawsuit asserted that the incident compromised current and former patients’ names, Social Security numbers, driver’s license numbers, dates of birth and medical and health insurance information.
