A proposed class and collective action has been filed against Franco Food Corp and three owners/managers who run an Associated Supermarket in the Bronx alleging violations of both federal and state labor laws. The plaintiff claims she and fellow employees worked 40+ hours per week without being paid proper minimum and overtime wages. The suit also claims the defendants failed to keep accurate time records and didn’t pay “spread of hours” wages to employees who worked more than 10 hours in a single shift as required by New York state labor law.
