Milk River Café, LLC, and two individual owners are the defendants in a lawsuit filed by a former employee who claims they failed to pay him proper overtime and spread-of-hours wages and also neglected to provide required wage documents. The plaintiff says he was employed as a dishwasher and often worked more than 40 hours per week without being paid time-and-a-half overtime wages for the hours he worked beyond 40 each week. He further alleges that he was not paid for an extra hour of work each time his shift lasted longer than 10 hours, in violation of state spread-of-hours laws. According to the complaint, the defendants failed to provide required wage notices when the plaintiff was hired, and neglected to record his hours and rates of pay in weekly wage statements throughout his employment.
