CommerceV3 Settlement Ends Class Action Lawsuit Over 2023 Data Breach Impacting Revival Animal Health Customers

A CommerceV3 class action settlement offers reimbursement and cash payments to those affected by a 2023 data breach.
CommerceV3 has agreed to a class action settlement that will offer Revival Animal Health, Inc. customers impacted by a 2023 data breach of the e-commerce platform reimbursements and other cash payments after their sensitive personal and financial information was exposed to an unauthorized third party.

The CommerceV3 class action settlement received preliminary court approval on May 29, 2025 and covers all Revival Animal Health, Inc. customers in the United States who were notified that their personal information—name, billing address, payment card number, CVV code and payment card expiration date—may have been compromised in the data breach.

CommerceV3 settlement class members who file a timely, valid claim form may receive up to $500 in compensation for “ordinary” out-of-pocket losses or expenses, up to $5,000 for “extraordinary” losses, and compensation for up to four hours of lost time dealing with the effects of the data breach, at a rate of $20 per hour.
The class action settlement website defines “ordinary” out-of-pocket losses as:
- Fees for credit reports, credit monitoring or other identity theft insurance products purchased between November 24, 2021 and May 29, 2025; and
- Out-of-pocket expenses incurred as a result of the CommerceV3 data breach, including long-distance phone charges, cell phone charges (if charged by the minute), bank fees, postage, cell data charges (if charged based on the amount of data used) or gasoline for local travel.
Per the settlement website, “extraordinary” losses incurred due to the data breach include:
- Proven monetary loss;
- Fees for credit repair services; and
- Professional fees such as attorneys’ and accountants’ fees.
To submit a claim form for ordinary, extraordinary or time losses, class members must submit documentation of the losses with their claim form, the settlement site states.
Alternatively, CommerceV3 settlement class members can submit a claim for a flat cash payment of $40, which requires no proof or documentation. This payment cannot be claimed in conjunction with any other reimbursement offers from the deal, the website specifies.
To submit a claim form online, class members must visit this page and log in with the unique class ID and PIN found in their copy of the settlement notice.
Alternatively, a PDF of the claim form is available to print, fill out and mail back to the address listed on the second page of the form.
All claim forms must be submitted online or postmarked by September 26, 2025.
A hearing is set for October 1, 2025 to determine whether the settlement will receive final approval from the court. Payments will begin to be distributed to eligible class members only after final approval has been granted and any appeals have been resolved.
The CommerceV3 class action lawsuit claimed that the e-commerce platform, which enables customers to place online orders for pet medication, experienced a cyberattack that potentially compromised the personal and financial data of approximately 82,000 customers of CommerceV3 client Revival Animal Health.
The settlement website notes that Revival Animal Health is not a party to the class action suit against CommerceV3 or accused of any wrongdoing.
