Class Action Lawsuit Says Boon PIVOT Toddler Kitchen Tower Step Stool Recall Is Inadequate

The maker of the recalled Boon PIVOT Collapsible Toddler Tower Kitchen Step Stool faces a proposed class action lawsuit over an apparent defect that can cause the product to tip over during ordinary use, posing a serious injury risk to young children.

The 25-page lawsuit against manufacturer TOMY International, Inc. was filed on the heels of the July 2026 recall of nearly 117,000 Boon PIVOT toddler step stools sold nationwide between January 2023 and June of this year. The U.S. Consumer Product Safety Commission (CPSC), which announced the recall with TOMY, urged consumers to immediately stop using the step stools, store them away from children, and contact the defendant for a free stabilizing repair part and installation instructions. 

However, the class action lawsuit contends that the Boon PIVOT toddler kitchen step stool recall “does little to make consumers whole,” given that, rather than provide full refunds for the product or a replacement free from flaws, the initiative “pushes the onus back on parents” to order replacement parts and fix the problem themselves. 

Even worse, the case continues, the defendant’s process for taking in affected products is “incomplete,” as the plaintiff allegedly found the company’s website to be repeatedly broken and unable to take her information, and the manufacturer to be “responsive only sporadically.” The plaintiff claims she was “left without a date certain as to when she will receive the paltry repair part, and indeed without confidence she will receive one.” 

According to the CPSC, TOMY is aware of 11 reports of the step stool towers being “unstable and shifting or leaning,” though no injuries have been reported. The towers are meant to give children from 18 months to four years old a step up to participate in kitchen tasks that may be on a table or countertop, such as preparing food, which can be beneficial to a child’s development, the lawsuit says. 

“Parents and caregivers would not have purchased the Toddler Tower had they known it would tip over in use, exposing their toddler to a risk of serious injury and death – or, at minimum, they certainly would not have paid the price premium TOMY charged for this Product,” the class action suit contends. 

The product recall class action lawsuit looks to cover all individuals in the United States who purchased a Boon PIVOT Collapsible Toddler Tower Kitchen Step Stool for personal use and not for resale during the “fullest period provided by law.”
