Class Action Lawsuit Alleges L & K Coffee Co. Misrepresents Amounts of Kona Coffee in Magnum Exotics Blend Product

A class action claims L & K Coffee Co.'s Magnum Exotics Kona blend coffee contains much less genuine Kona coffee than advertised.
A proposed class action lawsuit out of New York alleges the “Magnum Exotics”-label Kona blend coffee sold by L & K Coffee Co. contains far less Kona coffee than advertised. The latest lawsuit centered on claims of impropriety with regard to whether coffee sold by certain retailers actually comes from Hawaii’s Kona District, the suit alleges the defendant’s representations of its Magnum Exotics products are misleading in that the coffee’s composition “is different from what a reasonable consumer would expect given the labels and marketing.”
The suit states that while reasonable consumers would not expect a product labeled as a “Kona blend” to contain 100 percent Kona coffee, they would at least expect an amount significant enough to produce a taste of Kona coffee’s “unique and premium attributes.” The defendant’s so-called Kona blend coffee is misrepresented, according to the complaint, in that consumers believed the products “possessed functional, substantive, organoleptic, sensory, physical and other attributes which they did not."
L & K Coffee Co. allegedly mislabels its Kona blend coffee in an effort to “secure economic advantage in the marketplace against competitors,” the lawsuit claims.
