Northwood Hospitality, LLC and Naples Grande Resort & Spa are the defendants in a class action claiming the entities did not pay servers proper overtime and minimum wages. According to the complaint, the beach resort and spa’s owners and operators did not compensate proposed class members—tipped workers—at the Fair Labor Standards Act (FLSA)-required minimum wage after taking a tip credit to which they were not entitled. The plaintiff claims that even though he was employed as an hourly-paid worker who spent his work days performing non-tipped duties, he was unlawfully paid the minimum wage applicable to tipped workers. Furthermore, the plaintiff says he did not get paid at the time-and-a-half hourly rate for all hours he worked over 40 in a workweek.
