Circle K Settlement Ends Class Action Lawsuit Over May 2024 Data Breach

Gas Express, LLC, which does business as Circle K, has agreed to a class action settlement to resolve a lawsuit that alleged the nationwide convenience store chain failed to protect current and former employees’ sensitive information from a May 2024 cyberattack.

The Circle K class action settlement received preliminary approval from the court on April 16, 2026. The settlement covers all living United States residents who were sent notice from Gas Express, LLC stating that their private information was impacted in the May 2024 data breach.

Circle K settlement class members who file a valid, timely claim form can receive up to $2,000 for out-of-pocket losses incurred between May 20, 2024 and September 3, 2026 due to the data breach. This benefit covers documented losses related to identity theft or fraud and the costs of credit reports, credit monitoring, freezing or unfreezing credit, replacement IDs and miscellaneous expenses, such as notary and travel.

Class members must submit proof, such as receipts, to receive an out-of-pocket loss payment.

In lieu of an out-of-pocket loss payment, class members can instead file a claim form to receive a $50 cash payment, with no proof required.

Finally, in addition to either monetary benefit option, all class members can file a claim form to receive two years of CyEx Financial Shield Complete, which includes one-bureau credit monitoring and identity theft insurance.

To file a Circle K settlement claim form online, class members can head to this page and log in using the unique ID and PIN found on their copy of the settlement notice. Alternatively, class members can download a PDF of the claim form to print, fill out and return by mail to the settlement administrator.

All Circle K settlement claim forms must be submitted online or by mail by September 3, 2026.

The court will determine whether to grant final approval to the Circle K data breach settlement following a hearing on September 18, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.

The Gas Express class action lawsuit alleged that the chain of convenience stores and gas stations, operating as Circle K, failed to implement reasonable cybersecurity measures to protect the sensitive information of current and former employees, which led to a data breach on or around May 20, 2024. Per court documents, private information that may have been exposed in the Gas Express Circle K data breach included names and Social Security numbers.
