The owning and operating entities of the China Royal restaurant in New Jersey are the defendants in a class action over alleged unpaid overtime violations of the Fair Labor Standards Act (FLSA). Filed by a former delivery worker on behalf of anyone who was employed by the defendants within the last three years, the lawsuit claims workers were not paid at the time-and-a-half hourly rate for hours worked over 40 in a week.
The plaintiff claims he worked six days per week, often for more than 10 hours each day without receiving federally required meal and rest breaks, and was paid a flat rate per month regardless of how many hours he actually worked.
