Care Roadside Service, LLC and an individual with control of the business are facing a proposed collective action that claims they failed to pay their employees proper minimum and overtime wages. The plaintiff, who worked for the defendants as a roadside assistance technician from May to July 2017, says he was required to be on call seven days per week from 7:00 a.m. until 11:00 p.m. each day, which totaled 91 hours per week. He claims he did not receive overtime wages for the hours he worked above 40 each week and that his $10- to $13-per-car wage rate fell well below the required minimum wage.
