Capitol Wholesale Meats, Inc. joins employment agencies Total Staffing Solutions, Inc. and Elite Labor Services on 55th, LTD. as defendants in a proposed class action filed over an alleged “pattern or practice of denying employment to African-American laborers.”
According to the case, the two agencies assign workers to clients, including Capitol Wholesale Meats, to fill jobs “on a daily basis.” From July 2014 to July 2017, the agencies allegedly complied with a discriminatory request made by Capitol Meats to not assign it African American employees. The three individuals behind the suit claim they sought work from the agencies in 2016 but were denied open positions for which they were qualified at Capitol Wholesale Meats “in favor of Hispanic employees.” From the complaint:
“Capitol Meats’ hiring practices had a disparate impact on African-American job applicants because there were essentially no African-Americans assigned to Capitol Meats during the relevant class period, even though African-Americans make up a large percentage of individuals who apply to work at Elite and Total.”
The plaintiffs seek compensation for damages as well as injunctive relief prohibiting the defendants from continuing their alleged discrimination.
