A kitchen staff worker at Wesley Chapel, Florida’s Capital Tacos has filed suit against the restaurant’s operating company and an individual owner, claiming they owe him overtime wages. The plaintiff alleges that he routinely worked at least 50 hours per week in the Mexican restaurant's kitchen but was paid at his straight-time rate for all hours worked. He argues that under the Fair Labor Standards Act, he should have been paid time-and-a-half overtime wages for the hours he worked above 40 each week.
