A proposed class action filed against Cady Studio, LLC claims the photography studio broke federal labor laws by failing to reimburse photographers for expenses incurred while using their own vehicles to travel to photoshoots and customer events. Filed by a former photographer, the complaint alleges the vehicle reimbursement rates set by the defendants are calculated using a “flawed method” that pays workers at an “unreasonably low rate beneath any reasonable approximation” of the expenses they incur. This allegedly results in proposed class members’ wages falling below the federal minimum.
The suit notes that although the defendant reimburses its photogs on a per-mile basis, that rate is far below what the IRS requires with regard to owning and operating a vehicle. The formula used by the defendants to repay traveling photographers is the number of miles driven on a job divided by the window sticker mileage multiplied by the cost of a gallon of gas. This formula, the plaintiff argues, unlawfully leaves out reimbursement for other vehicle expenses incurred during the scope of proposed class members’ jobs.
