The entities behind Applebee’s Neighborhood Grill & Bar are on the receiving end of a proposed class action filed by a wheelchair-reliant consumer and “tester” who alleges the bar areas at the companies’ restaurants do not offer accessible seating at bar-counter dining surfaces.
The lawsuit lists 28 Applebee’s locations across Minnesota, California and Pennsylvania that the plaintiff claims have bar dining areas and bar-top seating that are inaccessible to patrons who use wheelchairs or scooters for mobility. Per the case, the plaintiff visited a Pittsburgh Applebee’s location and desired to be served at and use the bar-top dining surface only to learn that no accessible seating was available.
