The Toyota of North Miami class action settlement with defendant FRL Automotive LLC received preliminary court approval on November 24, 2025 and covers anyone in the United States who, between March 10, 2021 and September 20, 2025, received a text message from Toyota of North Miami (as reflected in text message logs produced in the litigation) and who opted out of receiving messages from the dealer but continued to receive texts 15 days after opting out.

Per court documents, more than 1,800 people are covered by the class action settlement.
Toyota of North Miami settlement class members who submit a timely, valid claim form can receive up to $85 per text message they received after they opted out of the dealer’s marketing texts. The amount per payment may be decreased on a pro rata, or equal share, basis, depending on the total number of valid claims filed, the class action settlement website says.
To file a settlement claim form online, class members can visit this page of the settlement website and log in with the unique claim number and PIN found in their copy of the settlement notice.
Alternatively, a PDF claim form is available to print, fill out and mail back to the address listed near the top of the form.
All Toyota of North Miami settlement claim forms must be submitted by April 9, 2026.
Per settlement documents, Toyota of North Miami has also agreed, as part of the deal, to ensure that its policies comply with the federal Telephone Consumer Protection Act (TCPA) and the Florida Telephone Solicitation Act (FTSA) moving forward.
A hearing is scheduled for March 25, 2026 to determine whether the class action settlement detailed on this page will receive final approval from the court. Payments will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Toyota of North Miami class action lawsuit claimed that the Toyota dealership sent marketing texts to consumers who had already opted out of receiving such texts, in violation of the TCPA and FTSA.
