A $650,000 class action settlement will resolve litigation against Refresco Beverages over a March 2023 data breach that may have exposed employees’ personal and health information.

The Refresco class action settlement received preliminary court approval on August 7, 2025 and covers anyone who received a notice letter in November 2023 stating that their personal information may have been compromised in the March 2023 Refresco data breach.
The court-approved website for the Refresco settlement can be found at RefrescoDataBreach.com.
Refresco settlement class members who submit a timely, valid claim form will be able to receive:
- Compensation for up to five hours lost time spent dealing with the effects of the data breach, at a rate of $20 per hour;
- Up to $500 in reimbursement for out-of-pocket expenses related to the Refresco data breach; and
- Up to $5,000 in reimbursement for “extraordinary” losses resulting from the incident.
Per the settlement website, claimable hours spent dealing with the data breach may include time spent changing passwords on potentially impacted accounts; contacting a medical provider or financial institution to discuss suspicious activity, or monitoring for or investigating suspicious activity on potentially impacted medical, financial or other accounts; signing up for identity theft or fraud monitoring; or researching information about the data breach, its impact or how to protect against potential harm.
Out-of-pocket expenses, the settlement website elaborates, may include costs such as unreimbursed bank fees, long-distance phone charges (including cell phone charges if charged by the minute), interest on short-term loans, postage, gasoline for local travel, identity theft insurance products or unreimbursed costs of credit reports, freezes or monitoring.
The extraordinary loss category includes documented monetary losses that occurred between March 2023 and December 4, 2025, for which the claimant already made reasonable efforts to avoid or seek reimbursement and which are not already covered by the time-spent or out-of-pocket reimbursement options. These may include, according to the website, unreimbursed costs, expenses, losses or charges resulting from identity theft or fraud, falsified tax returns or other possible misuses of class members’ private information.
In order to claim reimbursement for extraordinary losses, class members must provide reasonable documentation of the loss and a description of its relation or traceability to the Refresco data breach.
To submit a claim form online, class members can visit this page of the class action settlement website and log in with the unique notice ID and PIN found in their copy of the settlement notice.
Alternatively, a PDF of the claim form is available to print, fill out and mail back to the address listed on the first page of the form.
All claim forms must be submitted online or postmarked by December 4, 2025.
A hearing is scheduled for December 16, 2025 to determine whether the settlement will receive final approval from the court. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Refresco class action lawsuit claimed that the beverage company was negligent in its cybersecurity efforts, such that a data breach in March 2023 allowed unauthorized third parties access to employees’ sensitive personal information. This data, according to the suit, included names, Social Security Numbers, dates of birth, financial account numbers, street addresses, driver’s license numbers, health insurance policy numbers and certain health information provided in connection with workers’ compensation and/or ADA accommodations proceedings.
