$610K San Francisco 49ers Data Breach Settlement Aims to Resolve Lawsuit Over February 2022 Cyberattack

49ers Enterprises, LLC, which operates NFL team the San Francisco 49ers, failed to prevent a data breach in February 2022 that affected roughly 20,000 individuals, a class action claims.

The San Francisco 49ers have agreed to pay a $610,000 settlement that, if approved by the court, will resolve several consolidated data breach class action lawsuits that claimed the NFL team failed to prevent a February 2022 cyberattack that impacted more than 20,000 people.

The proposed data breach settlement with 49ers Football Company LLC covers a class of 20,930 U.S. residents who received notice from the 49ers that their personal and/or financial information was affected as a result of the data security incident that occurred between February 6 and February 11, 2022.
The lawsuit against the 49ers, filed in April 2023, alleged that the data breach not only compromised individuals’ names, dates of birth and Social Security numbers, but exposed information about employees’ immigration statuses and their dependents.
The plaintiffs notified the court of the agreement with the 49ers, and filed a motion detailing the terms of the deal, on November 15, 2024. It is now up to the court to determine whether to grant preliminary approval to the settlement terms.

If the deal is initially approved, class members who submit a timely, valid claim form may be entitled to receive up to $7,500 per person for out-of-pocket losses incurred after February 6, 2022 that “plausibly arose” from the data breach and are supported by documentation, the settlement agreement says.
To receive a 49ers settlement cash payout, class members must file a claim form by mail or online through the official settlement website once it is launched, the document relays.

In addition to the aforementioned cash benefits, class members may be entitled to receive a pro-rated share of any remaining settlement funds, the agreement states, noting that California residents would receive three shares each. Per the document, class members do not have to file a claim to receive this cash payout.
Finally, as part of the settlement, the 49ers have agreed to take certain measures to enhance the organization’s cybersecurity and better protect its network, the agreement adds.
According to the document, notice of the 49ers class action settlement will be mailed out within 30 days following preliminary approval of the deal. Class members will then have 90 days from the date of mailing to submit a claim form, the agreement shares.
