A $47.5 million settlement ends a class action lawsuit that alleged Motorola Solutions and Vigilant Solutions violated Illinois law by collecting, storing and using state residents’ biometric data in connection with providing to law enforcement the FaceSearch facial recognition technology and access to a gallery of booking photos.

The Motorola Solutions class action settlement, which received preliminary approval from the court on April 9, 2025, covers individuals who are or were Illinois residents, or were present in Illinois, at the time their face appeared in an image or images processed using the FaceSearch technology.
“What this means is that if you are or were an Illinois resident or were present in Illinois and your photo was taken or use by law enforcement, you may be a member of the Settlement class,” the court-approved settlement website, SimmonsBIPASettlement.com, states.
FaceSearch settlement class members who file a timely, valid claim form may receive a pro rata portion of the $47.5 million settlement, should the deal receive final approval from the court.
To file a claim form online, head to this page and click the “Click to Start Claim Form” button to begin the claim-filing process. Class members will need to enter their Unique Claim ID, found in the settlement notice you may have received. If you received no notice but would like to file a claim, continue with the online claim-filing process and provide the requested information to support your claim.
Alternatively, claimants may download a PDF of the claim form to print, fill out, and return by mail to the address listed on page 2 of the document.
All claims must be submitted online or by mail by July 29, 2025.
FaceSearch settlement class members who submit a timely, valid claim form online or by mail may receive a cash payment of approximately $200 to $550 as their equal share of the $47.5 million settlement, following the deduction of legal expenses and named plaintiff awards from the fund. Settlement payouts may increase or decrease depending on the total number of valid claims that are filed.
Compensation will begin to be distributed to eligible class members who submitted a valid, timely claim form should the deal receive final approval from the court at a hearing on August 20, 2025.
The class action lawsuit against Motorola Solutions and Vigilant Solutions alleged that the defendants ran afoul of the Illinois Biometric Information Privacy Act in connection with providing the FaceSearch tool and a gallery of booking photos to law enforcement customers without complying with the state law’s disclosure, consent, retention and deletion requirements.
