$4.5M AMN Healthcare Settlement Ends Lawsuit Over Alleged Monitoring, Recording of Language Interpretation Sessions

AMN Healthcare, Inc. and AMN Healthcare Language Services, Inc. have agreed to a $4.5 million settlement to resolve a privacy lawsuit that alleged the companies monitored and/or recorded language interpretation sessions between patients and medical providers without notice or consent.

The AMN Healthcare class action settlement received preliminary approval from the court on August 7, 2026. Eligible to participate in the settlement are all individuals who were physically present in California and whose communications were monitored or listened to and/or recorded by AMN, its employees, contractors, agents or persons acting on their behalf without obtaining prior consent, between December 4, 2022 and August 7, 2026.

Settlement class members who submit a timely, valid claim form can receive a pro rata cash payment, subject to a cap of $10,000 per person.
The final amount of each class member’s cash payment will be based on the total number of valid claims filed, among other factors.
Per court documents, AMN has also confirmed that it has instructed relevant employees to cease recording and monitoring interpretation sessions.
To submit an AMN Healthcare settlement claim form online, class members can head to this page and enter the class member ID found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form, available in a variety of languages, to print, complete and return by mail to the settlement administrator.
All AMN Healthcare settlement claim forms must be submitted online or postmarked by October 27, 2026.
The court will determine whether to grant the AMN Healthcare settlement final approval following a hearing on December 18, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The AMN Healthcare class action lawsuit alleged that the healthcare staffing agency monitored and/or recorded language interpretation sessions between patients and their medical providers without notifying them or obtaining prior consent, in violation of the California Invasion of Privacy Act.
