$4.1M Permobil SpeedControl Dial Settlement Ends Class Action Lawsuit Over Recalled Rotary Controllers

Permobil, Inc. and Max Mobility LLC have agreed to a $4,100,000 settlement to resolve a class action lawsuit filed after SpeedControl Dials for the SmartDrive MX2+ Power Assist Device for manual wheelchairs were recalled in 2025.

The Permobil SpeedControl Dial class action settlement received preliminary approval from the court on July 1, 2026. The agreement covers all individuals in the United States or its territories who purchased or were distributed a SpeedControl Dial for personal, family or household purposes between April 1, 2022 and July 1, 2026.

Permobil settlement class members who submit a timely, valid claim form with proof of purchase can receive up to $1,000 for reimbursement of verifiable out-of-pocket repair/replacement costs for the SpeedControl Dials.

Should the total value of all valid claims for repair/replacement reimbursements exceed $100,000, each class member’s cash payout will be decreased on a pro rata basis.

Class members must submit proof, such as receipts or invoices, to receive reimbursement for repair/replacement of the SpeedControl Dial.

Additionally, all class members can file a claim form to receive a pro rata cash payment, with no proof required.

To submit a Permobil SpeedControl Dial settlement claim form online, class members can head to this page and enter their information. Alternatively, class members can download a PDF claim form to print, complete, and return by mail to the settlement administrator.

All Permobil SpeedControl Dial claim forms must be submitted online or postmarked by August 31, 2026.

The court will determine whether to grant final approval to the SpeedControl Dial settlement following a hearing on October 29, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.

The Permobil SpeedControl Dial class action lawsuit alleged that Permobil and Max Mobility sold defective rotary controllers—which allow a user to start, stop, and control the speed of a mobility device such as a wheelchair—for the SmartDrive MX2+ Power Assist Device, in violation of the Magnuson-Moss Warranty Act.

The device was recalled by Permobil/Max Mobility in August 2025 due to a design issue that could cause “unexpected behavior” of the SmartDrive MX2+ motor, posing an injury risk.
