A $335,000 settlement has been reached that, if approved by the court, will resolve a proposed class action lawsuit over a cyberattack experienced by Futurity First Insurance Group, LLC (FFIG) in November 2023.

The proposed class action settlement with the life insurance and financial planning company covers all United States residents whose personal information was affected by the data breach, which occurred around November 24, 2023, and who received notice of the incident from FFIG.
The plaintiff notified the court of the settlement agreement with FFIG on May 21, 2025, asking the court to preliminarily approve the terms of the deal.
If the Futurity First Insurance Group settlement receives initial approval, class members who submit a timely, valid claim form by mail or online through the official settlement website may be entitled to receive benefits.

As part of the deal, class members who file a timely, valid claim form may be eligible to receive reimbursement of up to $10,000 per person for out-of-pocket expenses that were incurred as a result of the data breach and are supported by documentation, the settlement agreement shares. Per the agreement, examples of these costs may include losses related to identity theft or fraud; fees for attorneys, accountants or credit repair services; expenses associated with freezing or unfreezing credit; credit monitoring costs; charges for mileage, phone, notary or postage; and other miscellaneous expenses.
In addition, consumers who submit a claim form with documentation may receive reimbursement for up to five hours of time spent securing their credit, at a rate of $30 per hour, court documents state.
Furthermore, the settlement agreement relays that class members who file a claim form may choose between three years of credit monitoring services or a pro-rated cash payout of up to $300, which will be distributed from what remains of the settlement fund after the payment of credit monitoring services and the aforementioned reimbursement benefits.
According to the agreement, notice of the settlement will be mailed within 45 days following preliminary approval of the deal. Class members will then have 90 days from the date of mailing to file a claim form, the document adds.
The class action lawsuit against FFIG claimed the company failed to properly protect the private information of potentially thousands of individuals and businesses, allegedly storing the data unencrypted and in a “vulnerable manner” on its computer systems.
According to the suit, the highly sensitive information compromised by the Futurity First data breach included names, dates of birth, phone numbers, mailing and email addresses, driver’s license numbers, Social Security numbers, federal or state ID card numbers, financial account details and tax identification numbers.
