A $3.2 million class action settlement will end litigation against Eastern Radiologists over a November 2023 data breach that impacted the personal information of 884,935 people.

The Eastern Radiologists class action settlement received preliminary approval from the court on July 15, 2025 and covers anyone whose personal information was impacted by the data breach and was sent notice of the incident by Eastern Radiologists.

Eastern Radiologists settlement class members who submit a timely, valid claim form will be able to receive free medical account monitoring and either a pro rata (equal share) cash payment from the class action settlement fund or up to $5,000 in reimbursement for documented, out-of-pocket losses related to the data breach.
The medical account monitoring, court documents explain, includes one free year of CyEx Medical Shield, which provides $1 million of medical identity theft insurance, real-time authentication alerts, dark web monitoring, security freeze assistance, high-risk transaction monitoring and victim assistance.
Out-of-pocket monetary losses, per the settlement agreement, must have been incurred on or after November 20, 2023 and must have been more likely than not caused by the Eastern Radiologists data breach. Out-of-pocket losses may include:
- Costs associated with accessing or freezing/unfreezing credit reports with any credit reporting agency;
- Costs, losses, charges or expenses incurred due to identity theft/fraud, falsified tax returns or other misuse of a class member’s personal information;
- Charges for credit monitoring or other measures taken to mitigate the effects of the data breach; and
- Miscellaneous expenses related to the breach, such as postage, notary, mileage, copying and other charges.
Class members seeking reimbursement must provide reasonable documentation of each loss they wish to claim, the settlement website shares.
The pro rata cash payout and the out-of-pocket reimbursement option are mutually exclusive, meaning class members can choose only one to claim. The medical monitoring can be claimed alongside either of the other settlement benefits without restriction.
To submit a claim form online, class members can visit this page of the Eastern Radiologists settlement website and log in with the unique ID and PIN found in their copy of the settlement notice.
Alternatively, a PDF of the claim form is available to print, fill out and mail back to the address listed on the first page of the form.
All claim forms must be submitted online or postmarked no later than December 1, 2025.
Eastern Radiologists has also agreed, as part of the settlement, to implement additional data security measures to better protect the information in its possession.
A hearing is scheduled for December 15, 2025 to determine whether the Eastern Radiologists settlement will receive final approval from the court. Settlement benefits will begin to be distributed only after final approval has been granted and any appeals have been resolved.
The Eastern Radiologists class action lawsuit claimed that the company was negligent in its cybersecurity measures, allowing unauthorized third parties to access the sensitive personal data of 884,935 individuals in a data breach that occurred from November 20 to 24, 2023.
