A more than $3.05 million class action settlement will resolve litigation that alleged Froedtert Memorial Lutheran Hospital and other facilities unlawfully charged added fees to patients who requested digital copies of their healthcare records.

The Froedtert Memorial Lutheran Hospital class action settlement received preliminary court approval on June 25, 2025. The class action settlement covers anyone who requested their own patient healthcare records, or otherwise gave or received written authorization to retrieve the records, from Froedtert Memorial Lutheran Hospital, Inc.; Community Memorial Hospital of Menomonee Falls, Inc.; St. Joseph’s Community Hospital of West Bend, Inc.; or Froedtert and The Medical College of Wisconsin Community Physicians, Inc. and was charged a “paper copy” fee for electronic copies of the records by Verisma Systems between April 4, 2017 and April 5, 2018 or between April 4, 2020 and the present.

Froedtert settlement class members who submit a timely, valid claim form can receive reimbursement for the amount they paid in fraudulent “paper copy” fees, as well as a payment of $175.
To submit a claim form online, class members can visit this page of the settlement website and log in with the unique notice ID and PIN found in their copy of the settlement notice.
All class action settlement claim forms must be submitted by September 15, 2025.
According to the website, any class member who has already been reimbursed for “paper copy” fees for electronic medical records is ineligible to submit a claim form.
Should a class member need to update their address so their settlement check is mailed to the correct place, they can visit this page of the settlement website and log in with their notice ID and PIN.
A hearing is set for October 7, 2025 to determine whether the settlement will receive final court approval. Froedtert Memorial Lutheran Hospital settlement payments will begin to be distributed to class members only after final approval is granted and any appeals have been resolved.
The Froedtert Memorial Lutheran Hospital class action lawsuit alleged that Froedtert and its billing system, Verisma Systems, fraudulently charged patients and those acting on their behalf a “paper copy” fee for the retrieval of electronic copies of patient healthcare records.
