$2.7M+ Western Express Settlement Ends Class Action Lawsuit Over Alleged Robocalls

A more than $2.7 million class action settlement ends litigation against Western Express over alleged robocalls sent to consumers without consent.
Western Express will pay up to $2,718,945 to settle a class action lawsuit that alleged that the transportation solutions company placed pre-recorded calls and robocalls to consumers without consent.

The Western Express class action settlement received preliminary approval from the court on September 9, 2025 and covers as many as 14,697 people who, between May 28, 2020 and September 19, 2025, received at least one pre-recorded call despite having never provided their phone number to Western Express or any of its vendors, and whose cellphone number had been reassigned from another person who also did provide that number to Western Express or any of its vendors.

According to the settlement website, Western Express settlement class members who submit a timely, valid claim form will be able to receive a cash payment of up to $120 per person. The settlement payout may be reduced on a pro rata, or equal share, basis, depending on the total number of valid claims filed.
To submit a claim form, class members must visit this page of the Western Express TCPA settlement website and log in with the unique class member ID found in their copy of the settlement notice. Once logged in, claim forms may either be submitted online or printed and mailed to the address listed at the bottom of this page.
All claim forms must be submitted online or postmarked by December 15, 2025.
The court will determine whether the settlement will receive final approval at a hearing whose date is to be determined. Payments will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Western Express class action lawsuit claimed that the Nashville-based company placed robocalls without consent to cellphone numbers that, despite having been given to Western Express or its vendors by a previous user, had not been provided by the user who received the calls, allegedly in violation of the Telephone Consumer Protection Act.
