$2.5M Panera Settlement Ends Data Breach Lawsuit Over March 2024 Cyberattack

Panera faces a class action lawsuit in the wake of a significant March 2024 data breach impacting current and former employees.
Panera has agreed to pay a $2.5 million settlement to resolve a consolidated class action lawsuit over a March 2024 data breach that compromised the names and Social Security numbers of approximately 147,321 people.

The Panera class action settlement received preliminary approval from United States District Judge Henry Edward Autrey on July 14, 2025. The deal covers all U.S. residents to whom the restaurant chain sent notice of the Panera data breach, which reportedly impacted information belonging to current and former employees and a small number of customers, contractors and other individuals.
Eligible class members who submit a valid claim form by November 11, 2025 will be entitled to receive one or more Panera settlement payments.

To file a Panera claim form, you will need your unique class member ID, which can also be found in the personalized notice you should have received.
According to the official Panera settlement website, consumers who submit a timely, valid claim form will receive reimbursement of up to $500 per person for “ordinary” out-of-pocket costs that were incurred between February 9, 2024 and November 11, 2025 and are supported by documentation. Per the site, qualifying expenses must be unreimbursed and reasonably linked to the data breach, and may include phone charges, notary expenses, postage or travel-related fees, credit monitoring costs and other miscellaneous losses.

In addition, class members may file a claim for up to $6,500 per person for documented “extraordinary” losses that were incurred on or after February 9, 2024 and are not covered by the aforementioned reimbursement benefit, the website shares. “Extraordinary” losses may include costs incurred as a result of identity theft, fraud, falsified tax returns or other possible misuse of personal information, the site adds.
Consumers who seek this benefit may also submit a claim form for up to 10 hours of time spent handling issues related to the incident, at a rate of $25 per hour and subject to the $6,500 cap, the website relays.
Moreover, the site says, class members who were California residents at the time of the Panera data breach can file a claim for a cash payout of up to $100.
Lastly, according to the website, consumers who submit a timely, valid claim form are eligible to receive a pro-rated share of what remains of the settlement fund after deductions are made for all other Panera settlement benefits, administration costs, attorneys’ fees and service awards. These payments will be capped at $250 per person and will depend on how many valid claims are filed, the site notes.
All Panera settlement payouts are subject to reduction on a pro rata basis to exhaust the settlement fund, court documents state.
The court must still decide whether to grant final approval to the terms of the settlement agreement, which would resolve the Panera data breach lawsuit. A final approval hearing is set for January 29, 2026.
Class action settlement payments will be issued to eligible consumers only if the deal receives ultimate court approval and after any appeals are resolved.
