The Octapharma class action settlement received preliminary court approval on July 31, 2025 and covers any living U.S. resident who was notified by Octapharma that their personal information may have been compromised in the data breach, which occurred on or around April 17, 2024.
The court-approved website for the Octapharma settlement can be found at OPIDataSettlement.com.
Octapharma settlement class members who file a timely, valid claim form may be able to receive credit monitoring services and either reimbursement for up to $5,000 in losses resulting from the data breach or a flat cash payment of $100. Class members who were California residents as of April 17, 2024 are also eligible to claim a separate cash payment, the class action settlement website states.
To receive reimbursement for losses related to the Octapharma data breach, class members must submit valid documentation of each loss. Per the settlement site, class members cannot claim losses that have already been reimbursed by another source, including by the credit monitoring and identity protection services offered in the original Octapharma data breach notification letter.
This reimbursement is mutually exclusive from the flat cash payment of $100, and a class member cannot claim both at the same time, court documents explain.
The credit monitoring, which can be claimed alongside any of the other available settlement benefits, includes three years of three-bureau, real-time credit monitoring, medical identity monitoring, comprehensive public record monitoring, dark web scanning with immediate notification of potential misuse, identity theft insurance with no deductible and access to fraud resolution agents.
Class members who resided in California as of April 17, 2024 may, in addition to the credit monitoring and either the reimbursement option or flat cash payment, claim an additional flat cash payment that is estimated to be about $50.
Octapharma settlement class members should note that any reimbursement or cash payment may be increased or decreased on a pro rata, or equal-share, basis depending on the number of valid claims filed.
To file a claim form online, class members may visit this page and log in with the unique claim ID and PIN found in their copy of the settlement notice.
All claim forms for the Octapharma Plasma settlement must be submitted no later than November 14, 2025.
Octapharma Plasma has also agreed, as part of the settlement, to increase its cybersecurity measures to better defend the information it possesses.
A hearing is scheduled for December 4, 2025 to determine whether the Octapharma class action settlement will receive final approval from the court. Settlement benefits will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The Octapharma class action lawsuit claimed that the plasma donation center operator failed to properly defend against a data breach in which unauthorized third parties accessed valuable personal and medical information, including Social Security numbers, names, dates of birth and health information, including donor eligibility.
