$1M Splish Splash Settlement Ends Class Action Over Allegedly Hidden Ticket Fees

A class action claims the operator of Splish Splash has unlawfully hidden a $4 “processing fee” from the total cost of an admission ticket until the end of the online purchasing process.

The company that operates Splish Splash waterpark has agreed to a $1,000,000 settlement to resolve a class action lawsuit that alleged the Calverton, New York, facility unlawfully hid from consumers a $4 processing fee for admission tickets until the end of checkout.

The $1 million Splish Splash class action settlement with Palace Entertainment received preliminary approval from the court on March 18, 2026. The deal covers all United States residents who purchased electronic tickets to the Splish Splash waterpark through www.SplishSplash.com at any time from August 29, 2022 through March 5, 2024 and were charged processing fees.
The court-approved website for the Splish Splash class action settlement can be found at SplishSplashTicketFeeSettlement.com.
According to the settlement agreement, class members who submit a timely, valid claim form are eligible to receive a cash payment. The amount of each class member’s pro rata cash payment will depend on the amount of fees they paid, court documents state.
Additionally, Splish Splash has agreed to update its online checkout process to either not charge a ticket processing fee or, if fees will be charged, clearly and conspicuously disclose the total cost of an admission ticket, inclusive of fees, before a ticket is selected for purchase.
To submit a Splish Splash settlement claim form online, class members can head to this page and enter the unique ID and PIN found on their copy of the settlement notice.Alternatively, class members can download a PDF claim form to print, complete and return by mail to the settlement administrator.
All Splish Splash settlement claim forms must be submitted online or postmarked by August 10, 2026.
The court will determine whether to grant the Splish Splash class action settlement final approval following a hearing on June 25, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Splish Splash class action lawsuit alleged that the waterpark unlawfully concealed a $4 processing fee for all online ticket purchases until the end of the checkout process, in violation of New York’s Arts and Cultural Affairs Law.
