$15M Bestway Settlement Resolves Class Action Lawsuit Over Recalled Above-Ground Pools

Bestway has agreed to a $15 million settlement to resolve a class action lawsuit that alleged certain recalled above-ground pools posed an unreasonable drowning risk due to a potential safety defect.

The Bestway class action settlement received preliminary approval from the court on May 4, 2026. Eligible to participate in the settlement are all individuals in the United States, its territories and/or the District of Columbia who purchased, for personal use and not for resale, a Bestway-branded pool 48 inches or taller in height (including Power Steel and Steel Pro models) with compression straps located outside of the support poles, sold from 2008 through 2024.

Bestway settlement class members who submit a timely, valid claim form with proof of purchase can receive a cash payment equal to 10 percent of either the actual purchase price they paid (as reflected in the proof of purchase) or the average retail price of the affected Bestway product if no actual price is reflected in the proof of purchase.
Alternatively, class members can file a claim form with no proof of purchase to receive a $40 cash payment.
To submit a Bestway settlement claim form online, class members can head to this page and select whether they have a settlement claim ID, which can be found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete, and return by mail to the settlement administrator.
All Bestway settlement claim forms must be submitted online or postmarked by October 30, 2026.
The court will decide whether to grant final approval to the Bestway settlement following a hearing on November 20, 2026. Compensation will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Bestway class action lawsuit alleged that the pool manufacturer failed to disclose that certain models of its above-ground swimming pools sold between 2008 and 2024 that were 48 inches or taller were equipped with compression straps that could be used to climb into the pool, posing a drowning risk. The suit further alleged that the voluntary recall issued by Bestway was inadequate because it did not offer consumers monetary compensation.
