A $12M+ settlement ends a Speedway lawsuit claiming that the company's Illinois locations did not obtain proper consent to track employees' hours with a finger scanner.
A class action settlement worth over $12 million will resolve litigation that alleged Speedway’s use of a finger scanner to track employees’ hours without first providing notice and receiving consent in writing violated the Illinois Biometric Information Privacy Act.

The Speedway class action settlement received preliminary court approval on July 10, 2025 and covers anyone who, between September 1, 2012 and November 1, 2017, used a finger scanner on a time clock while working for Speedway in Illinois.
The court-approved website for the Speedway settlement can be found at SpeedwayBIPASettlement.com.
Per the website, no action is required on the part of Speedway settlement class members to receive a payment from the $12,122,775 settlement fund. The court estimates that Speedway class action settlement payouts will be approximately $970 per person, after the deduction of all settlement fees and costs.
Settlement payments will be distributed via mailed check to the last known address of each class member. Any class member who needs to update their address must visit this page and log in with the unique ID and PIN found in their copy of the settlement notice.
An addendum to the settlement states that, should $74,000 or more remain in uncashed checks after the 120-day check-cashing period, the court will distribute the remaining money to the settlement class members on a pro-rata, or equal-share, basis.
A hearing is set for October 21, 2025 to determine whether the class action settlement will receive final approval from the court. Payments will begin to be distributed to class members only after final approval has been granted and any appeals have been resolved.
The Speedway class action lawsuit alleged that the company’s use of finger scanners on its employees without first providing notice and receiving written consent violated the Illinois Biometric Information Privacy Act.
