Class members who submit a timely, valid claim form can receive up to $1,000 for documented, unreimbursed “ordinary” losses incurred between June 1, 2023 and January 19, 2027 due to the data breach.
In addition, class members can file a claim to receive up to $10,000 for documented, unreimbursed “extraordinary” losses incurred during the same time period due to the Kisco data breach. This benefit covers proven monetary losses from identity theft or fraud, falsified tax returns, or other misuse of a class member’s personal information.
Class members must submit proof, such as receipts, to receive a documented “ordinary” and/or “extraordinary” loss payment.
Additionally, class members can file a claim form to receive reimbursement for up to five hours of lost time spent remedying issues related to the data incident, at a rate of $30 per hour, subject to the $10,000 cap on documented “extraordinary” loss payments. This benefit covers time spent addressing identity theft or fraud, falsified tax returns, or other possible misuse of a class member’s information.
Settlement class members who lived in California at any time from June 1 to June 6, 2023 can submit a claim to receive a $250 statutory cash payment.
Further, class members can file a claim form to receive a residual cash payment from what remains of the net settlement fund after the payment of all other settlement benefits and expenses.
Should the total value of all claims for documented losses, lost time, and California statutory payments exceed the amount that remains in the net settlement fund after all settlement expenses have been paid, payouts to class members will be reduced on a pro rata (proportional) basis.
Lastly, class members can elect on their claim form to receive three years of three-bureau credit monitoring.
To file a Kisco Senior Living settlement claim form online, class members can visit this page and enter the CPT ID and passcode found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form to print, complete, and return by mail to the settlement administrator.
All Kisco Senior Living settlement claim forms must be submitted online or postmarked by January 19, 2027.
The court will determine whether to grant final approval to the Kisco Senior Living class action settlement following a hearing on March 18, 2027. Settlement benefits will begin to be made available to class members only after final approval has been granted and any appeals have been resolved.
The Kisco Senior Living class action lawsuit alleged that the senior living facility operator failed to implement adequate cybersecurity safeguards to protect sensitive information, including names and Social Security numbers, from a data breach that occurred from June 1 to June 6, 2023.
