$1.75M American Vision Partners Settlement Ends Data Breach Lawsuit Over 2023 Incident

American Vision Partners has agreed to a $1.75 million class action settlement to wrap up a lawsuit that alleged the eye care practice management group failed to protect sensitive information from unauthorized access during a November 2023 data breach that affected roughly 1.6 million people.

The American Vision Partners class action settlement received preliminary approval from the court on June 30, 2026. The deal covers all individuals whose personal information was collected or maintained by American Vision Partners, including approximately 258,070 United States residents whose Social Security numbers and other personal details were compromised in the data breach.

Settlement class members whose Social Security numbers (SSNs) were compromised in the incident and who submit a valid, timely claim form can receive up to $3,000 in reimbursement for out-of-pocket losses stemming from the American Vision Partners data breach. This benefit covers losses from fraud or identity theft and costs for professional fees, credit repair services, freezing/unfreezing credit, credit monitoring, notary fees and more.

Class members whose SSNs were impacted in the cyber incident must submit proof, such as receipts, to receive out-of-pocket-loss reimbursement. 

In lieu of an out-of-pocket-loss payout, class members whose SSNs were impacted in the data breach can submit a claim form for a pro rata cash payment, with no proof required. 

The amount of each class member’s cash payout will depend on the total number of valid claims filed, among other factors. 

As part of the class action settlement, American Vision Partners has also agreed to implement and maintain certain cybersecurity measures valued at more than $2.7 million, including the creation of a chief information officer role, retention of a dedicated information security training specialist, formation of a cybersecurity steering committee and more. 

To submit an American Vision Partners settlement claim form online, class members can head to this page and enter the class member ID found on their copy of the settlement notice. Alternatively, class members can download a claim form to print, complete and submit by mail to the settlement administrator. 

American Vision Partners settlement claim forms must be submitted online or by mail by November 12, 2026. 

The court will determine whether to grant final approval to the American Vision Partners data breach settlement following a hearing on December 10, 2026. Settlement benefits will begin to be distributed after final approval has been granted and any appeals are resolved. 

The lawsuit against Medical Management Resource Group, which does business as American Vision Partners, alleged that the Arizona-based service provider for ophthalmology practices failed to have in place reasonable, industry-standard cybersecurity measures, leading to a data breach on or around November 14, 2023. According to the suit, millions of consumers’ names, dates of birth, contact information, medical treatment details and more were compromised by unauthorized actors during the incident.
