$1.5M SeaWorld Settlement Ends Class Action Lawsuit Over Alleged Auto-Renewal of Annual Passes

A $1.5 million settlement will resolve a class action lawsuit over SeaWorld’s alleged failure to obtain affirmative consent from customers regarding the automatic renewal of annual passes to SeaWorld San Diego.

The Seaworld class action settlement, which received preliminary court approval on April 18, 2025, covers anyone with a California home or billing address on file with SeaWorld and whose annual pass to SeaWorld San Diego—purchased via the San Diego SeaWorld website or mobile app on or after February 28, 2019—was automatically renewed at the end of the 12-month period on or before February 28, 2025, and who did not already receive a refund for the first, undesired auto-renewal charge.

Settlement class members should have received a notice about the deal via email around May 28, 2025, and may receive a pro rata, or equal share, portion of the net settlement amount, after the payment of administration costs, attorneys’ fees and service awards for the lead plaintiffs. The settlement website states that an estimated 141,358 people are class members for the SeaWorld San Diego deal.
According to the class action settlement website, no action will be required by class members to receive compensation from the deal, as settlement payouts will be sent directly. Eligible consumers will receive a notification to select the method of settlement cash delivery, including electronic payment, direct deposit and paper check.
A hearing is set for August 15, 2025 to determine if the settlement will receive final court approval. After final approval is granted, and after any appeals are resolved, compensation from the SeaWorld settlement will begin to be distributed to eligible class members.
The SeaWorld class action lawsuit alleged that SeaWorld Parks and Entertainment Inc. unlawfully failed to disclose that customers’ annual pass purchases would automatically renew at the end of the initial 12-month period and thus charged customers for the renewal without their consent.
