A $1.2M First Commonwealth Federal Credit Union settlement is set to end litigation over a June 2024 data breach.
First Commonwealth Federal Credit Union (FCFCU) has agreed to a $1.2 million class action settlement to resolve litigation alleging the Pennsylvania-based financial institution failed to properly safeguard private consumer information, leading to a June 2024 data breach.

The First Commonwealth class action settlement received preliminary approval from the court on October 16, 2025, and covers all United States residents whose private information may have been compromised during the June 2024 data breach, including those who received notice of the incident from FCFCU. Per court documents, approximately 98,817 individuals were affected by the FCFCU data breach.

According to the site, FCFCU settlement class members who submit a timely, valid claim form have multiple options for reimbursement. Those who submit with their claim form documented proof of out-of-pocket expenses are eligible to receive a one time cash payment of up to $5,000, referred to as “Cash Payment A” on all court documents. The settlement site notes that these expenses must have been incurred as a result of the data breach, and include those related to changing bank account information and identity theft protection.
Alternatively, class members may instead elect to receive a one-time cash payment of approximately $100 in lieu of documented losses, referred to as “Cash Payment B” on all court documents. The settlement agreement further explains that payments may become pro-rated depending on the number of claims filed and what remains in the settlement fund after the payment of attorneys’ fees, lead plaintiff service awards, settlement administration costs, and the cost of all other benefits.
In addition to monetary benefits, FCFCU class members are also eligible to enroll in three free years of CyEx Identity Defense Complete, which provides services such as dark web scanning, security freezing assistance, victim assistance, identity theft insurance, and access to fraud resolution agents.
To submit a claim form online, class members can go to this page and enter the unique class member ID found on their copy of the settlement notice. Alternatively, class members can download a PDF claim form from the settlement site, complete it, and mail it to the settlement administrator.
All FCFCU claim forms must be submitted online or postmarked by February 18, 2026.
The court will determine whether to grant final approval to the FCFCU settlement at a hearing scheduled on March 5, 2026. Compensation will begin to be distributed only after final approval is granted and any appeals are resolved.
The First Commonwealth Federal Credit Union class action lawsuit alleged that the Pennsylvania credit union failed to adequately safeguard the consumers information stored on its systems, leading to a June 2024 data breach that allegedly compromised data including names, Social Security numbers, bank account and card numbers, usernames and passwords.
