The Behavioral Health Resources class action settlement received preliminary approval from the court on September 12, 2025 and covers all United States residents whose private information was impacted by the November 2024 data breach. The Behavioral Health Resources data breach reportedly impacted 50,083 individuals.
The court-approved website for the Behavioral Health Resources settlement can be found at https://BHRSettlement.com/.
According to the settlement site, Behavioral Health Resources settlement class members who submit a valid, timely claim form have multiple options for reimbursement. Class members who submit with their claim form documented proof of out-of-pocket losses are eligible to receive a one-time cash payment of up to $5,000. The site further details that reimbursable expenses covered by the deal must have occurred between November 20, 2024 and January 12, 2026, and include losses related to identity theft, credit monitoring fees and costs to replace IDs.
Moreover, class members who spent time addressing issues related to the data breach are eligible to claim a maximum of five hours of lost time at a rate of $25 per hour, which covers time spent changing passwords, remedying identity theft or fraud, and investigating suspicious activity amongst accounts.
The settlement site adds that class members may also submit a claim form for a one-time, pro-rated cash payment of approximately $100, which may increase or decrease depending on the number of valid claims filed.
The settlement agreement outlines that class members are eligible to claim all applicable benefits from the deal, and payments can be made via check or electronic payment. Class members must cash all class action settlement checks within 120 days after issuance before expiration.
In addition to monetary reimbursements, all settlement class members are eligible to enroll in three free years of CyEx Medical Shield Total, which provides medical data monitoring for health insurance information, medical records, and unauthorized Health Savings Account spending.
To submit a Behavioral Health Resources Settlement claim form online, class members can head to this page and enter the class member ID found on their copy of the settlement notice. Consumers who believe they may be a class member but did not receive a class action settlement notice should contact the settlement administrator to confirm their identity and receive their login ID.
Alternatively, class members can download a PDF of the claim form to print, fill out, and return by mail to the address listed on the second page of the document.
All Behavioral Health Resources claim forms must be submitted online or by mail by January 12, 2026.
The court will determine whether to grant final approval to the Behavioral Health Resources settlement at a hearing on February 6, 2026. Compensation will begin to be distributed to class members only after final approval is granted and any appeals are resolved.
The Behavioral Health Resources class action lawsuit claimed that the healthcare provider failed to properly secure its online systems to protect the private information in its care and, as a result, cybercriminals were able to access its network and patient data. Per court documents, the impacted private data of former and current Behavioral Health Resources included, but was not limited to, names, dates of birth, Social Security numbers, medical information, health records, ID information and health insurance information.
