Broadhollow Hospitality LLC, which owns New York's Jewel Restaurant and Rubie's Costume Company, is the defendant in a proposed class action filed by former employees.
Broadhollow Hospitality LLC, which owns New York’s Jewel Restaurant and Rubie’s Costume Company, is the defendant in a proposed class action filed by former tipped employees who claim their wages were stolen. According to the suit, managers for the defendants allegedly took a tip credit on servers’ and bartenders’ wages to which they were not entitled, causing the workers’ pay to fall below the minimum benchmark. This was done, the complaint alleges, by including managers in proposed class members’ tip pools, particularly for private events, even though their job duties were non-tipped under the Fair Labor Standards Act (FLSA).
The lawsuit also claims proposed class members were not paid for required off-the-clock work. One example of this, the suit notes, is when the defendants required proposed to class members to come in early but would not allow them to clock in until their scheduled shifts officially began.
