An individual formerly employed as a claims generalist associate by Progressive Casualty Insurance Company claims he and similarly situated employees were not paid proper overtime wages under the Fair Labor Standards Act (FLSA). The plaintiff, who answered customer service calls and handled automotive property insurance claims from November 2015 through August 2016, alleges the defendant unlawfully failed to include shift premiums—paid to workers who work difficult-to-staff shifts—in calculating overtime pay. Similarly, Progressive Casualty Insurance Company also allegedly failed to account for pay under its “Gainshare Program,” additional pay based on the company’s performance, when tallying workers’ overtime compensation.
