A proposed class action filed in Missouri claims defendant Onshore Technology Services, Inc. violated the Fair Labor Standards Act (FLSA) by failing to pay current and former quality assurance technicians proper overtime wages. The plaintiff claims the defendant, a company that provides technology resources supporting clients’ applications and lines of code, failed to pay him and similarly situated workers time-and-a-half for all hours worked over 40 in a workweek. The plaintiff claims quality assurance technicians work an average of 50 to 60 hours per week without proper wages.
More specifically, the plaintiff claims the defendant “purports to contract with individuals” who it unlawfully classifies as exempt from overtime pay, thereby avoiding its FLSA time-and-a-half overtime obligation.
