Miami Striping, Inc. and its owner are the defendants in a proposed class action that claims the parties violated the Fair Labor Standards Act (FLSA) by failing to pay proper overtime wages. The plaintiff, who worked for the defendants as a laborer from August 2015 through January 2016, claims he worked an average of 55 hours per week without being paid at the time-and-a-half overtime rate for all hours worked over 40. The case estimates the plaintiff is owed more than $3,000 in unpaid wages.
