From the Western District of Texas comes a proposed class action that claims SA Family Help and Hope LLC and its owner failed to pay proper overtime wages to individuals employed as caregivers. The plaintiff, tasked with providing care to the defendants’ elderly and infirm clients, claims she regularly worked 12-hour shifts six days a week without being paid at the time-and-a-half hourly rate for all hours worked over 40. The complaint claims the defendants ignored a Department of Labor regulation stating that, starting January 1, 2015, all caregivers employed by an agency must be paid overtime under the Fair Labor Standards Act (FLSA). Instead, the defendants allegedly classified proposed class members as independent contractors as a means of avoiding paying overtime.
