A woman formerly employed as a home attendant by Rosa’s First Quality Home Healthcare, LLC has sued the company and its owner to recover allegedly unpaid overtime wages. Filed on behalf of all individuals currently or formerly employed as home attendants and in similar roles, the case claims employees working in these positions are “consistently and uniformly” denied time-and-half overtime pay after working more than 40 hours and, sometimes, on the seventh consecutive workday in a week.
The lead plaintiff in the action claims she routinely worked 30 to 45 overtime hours every week—an estimated 2,281.5 overtime hours between August 2015 and March 2017, the lawsuit says—without appropriate time-and-a-half pay.
