A former employee of KC Transport, Inc. has filed a lawsuit against the coal-hauling company and an individual owner, alleging that they misclassified her as exempt.
A former employee of KC Transport, Inc. has filed a lawsuit against the coal-hauling company and an individual owner, alleging that they misclassified her as an exempt employee and failed to pay her overtime wages. The plaintiff, who worked for KC Transport as a truck driver, claims she often worked up to 70 hours per week without receiving overtime compensation for the hours she worked above 40. According to the lawsuit, the plaintiff’s job duties did not qualify her as an exempt employee under the Fair Labor Standards Act, and she was entitled to proper overtime wages throughout the duration of her employment with KC Transport.
